WASHINGTON, D.C., May 23, 2013 — The American Bar Association and Random House Reference announce a new book, The American Bar Association Legal Guide for Military Families, First Edition to help military members, veterans and their families handle a wide variety of legal issues.

WASHINGTON, D.C., May 23, 2013 — The American Bar Association and Random House Reference announce a new book, The American Bar Association Legal Guide for Military Families, First Edition to help military members, veterans and their families handle a wide variety of legal issues.

There are an estimated 1.4 million active service members and 23 million veterans. However, many of these military families are not fully aware of their legal rights.

“The Legal Guide for Military Families complements the important work being done by state and local bar associations throughout the nation to provide legal services to military personnel and their families,” said Kim Askew, chair of the ABA Standing Committee on Public Education. “The guide helps military members and their families to understand their rights and protections and to know when to seek legal assistance.”

David G. Ehrhart, a retired Air Force brigadier general and chair of the ABA Standing Committee on Legal Assistance for Military Personnel, added, “Of the many sacrifices made by our nation’s military families, many of which often go unseen, one sacrifice these families should never make is in having a clear understanding of the legal rights and special protections available to them.”

“The guide successfully bridges the knowledge gap for service members, veterans and their families between their awareness of legal rights and their need for counsel to help resolve their legal issues,” Ehrhart said.

The guide is written by highly accomplished attorneys who have worked for years with military service members and their families. The user-friendly tips give readers what they need to make informed legal decisions.

For example, the guide:

Locates state and federal resources, including pro bono clinics and legal aid offices

Explains eligibility requirements for veterans benefits

Manages family law issues (marriage, divorce, child custody and ex-spouses)

Details benefits for same-sex spouses

Explains estate planning basics and life insurance

Explains health care and disability insurance/coverage

Advises on negotiation for the sale of homes and vehicles

Navigates the Servicemembers Civil Relief Act (a federal law that provides protections for military members when they enter active duty)

Trevor Orsinger, an attorney in the General Counsel’s Office at Fermi Research Alliance in Batavia, Ill., and a contributor to the guide, observed: “The United States provides incredible programs that benefit veterans in countless ways. As a veteran of Operation Iraqi Freedom and a lawyer in Illinois, I understand how difficult it can be to access those benefits. Wading through those processes can be a daunting task, even for the most-experienced service members.”

“The ABA’s Legal Guide for Military Families is an outstanding guide and a must-have for any attorney who helps those who have given so much for this country,” added Orsinger, who is also a military attorney in the Illinois Air National Guard.

The book is published by the ABA Division for Public Education in partnership with Random House Reference.

CHICAGO, May 15, 2013 — For more than 30 years, lawyer and author Jim McElhaney has delivered perceptive insights and practical guidance to both veteran and new lawyers alike, primarily through his columns in the ABA Journal.

Through his prolific career, McElhaney has written the book on litigation. Now, his latest effort, McElhaney’s Litigation, Volume II, captures his time-tested advice through a collection of columns published in the magazine between 1994 and 2011.

McElhaney’s book continues his tradition of presenting useful, entertaining advice in a clear, simple, effective way that every lawyer will find invaluable. In McElhaney’s Litigation, Volume II, McElhaney provides comprehensive advice on how to avoid the snares, traps and pitfalls that challenge every trial lawyer, regardless of experience. He shows, with wit, clarity and simplicity, how to conduct the best trial a lawyer is capable of conducting and offers techniques and strategies based on actual courtroom experience.

McElhaney, who lives in New Mexico, is one of the most respected and prolific writers to contribute to the ABA and the ABA Journal. His litigation column appeared every month in the magazine for 25 years, and his “Trial Notebook” column appeared four times a year for nearly 30 years in Litigation magazine, published by the ABA Section of Litigation. McElhaney has also devoted many years to law school teaching, hundreds of continuing legal education appearances and trial consulting. He is regarded as one of the country’s most authoritative sources on litigation.

CHICAGO, May 3, 2013 — Bioinformatics is rapidly evolving, and a new book by the American Bar Association Section of Science and Technology Law provides a valuable and much-needed resource to keep up with the continuously changing field.

The book, Bioinformatics Law: Legal Issues for Computational Biology in the Post-Genome Era, will serve as a useful resource for lawyers, researchers, policymakers and scholars on the complex intersection of law and bioinformatics. A host of experts, from law to science, offers insights and research that will help in navigating this complex environment and cutting-edge research into bioinformatics, a field that develops and improves upon methods for storing, retrieving, organizing and analyzing biological data.

Thousands of laboratories across the globe are studying the human genome sequence, with new associations between genetic variations and diseases and physiological traits announced weekly. Many experts say the world has entered a “post-genome” era, a time in which the availability of the human genome sequence is taken as a given and serves as a starting point for multiple new and innovative research endeavors.

The book tackles a range of issues associated with this booming field, from the intellectual property landscape that deals with patents and other areas to the legal issues raised by software tools that enable large-scale computational biology. Also covered are the legal aspects of the research environments in which bioinformatics work is increasingly conducted, including biopharma collaborations and university research and development, among many other areas.

About the Authors

Jorge L. Contreras is an associate professor at American University’s Washington College of Law. His research focuses primarily on the effects of intellectual property structures on the dissemination and production of technological innovation, with a focus on basic scientific research and technical standards. Contreras is co-chairman of the ABA Section of Science and Technology Law’s Committee on Technical Standardization and a member of the National Academy of Science’s Committee on Intellectual Property Management in Standard-Setting Processes. He is the editor of the Technical Standards Patent Policy Manual (ABA Publishing: Chicago, 2007) and has written numerous articles, book chapters and blog postings relating to intellectual property and standards development. He recently became the founding editor of the Social Science Research Network’s Law, Policy and Economics of Technical Standards eJournal, and in 2011, he was awarded first place in the Society for Standards Professionals’ World Standards Day Paper Competition (together with co-authors). Before joining the faculty of American University, Contreras was senior lecturer and acting director of the Intellectual Property Program at Washington University in St. Louis and a partner at the international law firm of Wilmer Cutler Pickering Hale and Dorr LLP. He is a cum laude graduate of Harvard Law School.

Dr. A. Jamie Cuticchia has more than 20 years of academic and industry experience leading groups in computational biology, genomics, high-performance computing, software engineering and genome database construction. He has held numerous leadership positions, including professorships at the Johns Hopkins University School of Medicine and the University of Toronto Faculty of Medicine. Cuticchia founded the Ontario Center for Genomic Computing, a Top 500 Supercomputing Center and the largest supercomputing center devoted solely to addressing issues of life sciences. He also held several full- and part-time industrial positions, including director of computational biology for the MITRE Corp., director of bioinformatics and genomics for ChemGenics Pharmaceuticals, director of drug discovery information technology for Millennium Pharmaceuticals, consulting vice president of genomic information for Ceres Genomics, chief information officer for SynX Pharmaceuticals, and scientific founder of New Chemical Entities. Cuticchia was also director of bioinformatics for the Research Triangle Institute. After several years at RTI, he went to the Duke University Health System, where he held numerous positions, including Duke bioinformatics scholar. He completed a law degree and was licensed by the North Carolina Bar to practice law. He is presently winding down his work at Duke and transitioning to his new law practice, AJC Legal Services. Cuticchia, however, intends to remain active in the scientific field.

CHICAGO, May 3, 2013 — A new book from the American Bar Association Section of Litigation provides a state-by-state primer for lawyers to better understand litigating class action suits in each of the nation’s state court systems.

The Law of Class Action: Fifty-State Survey 2012-2013 represents a valuable tool for both in-house and outside counsels who confront the possibility of a class action suit in a state in which they have little or no experience and must make informed recommendations on removal. Experienced litigators from each of the states have prepared summaries that address changes in rules and statutes as well as significant case law.

The survey serves as a comprehensive guide for state court class action litigation that came about after the 1985 U.S. Supreme Court decision in Phillips Petroleum Co. v. Shutts (427 U.S. 797). In that decision, the high court found that state courts, within certain due process constraints, can adjudicate claims of nonresident class members, a ruling that opened the door for state courts to entertain suits that traditionally were in federal forums.

The Section’s Class Actions and Derivative Suits Committee prepared the book.

About the Editors

CHICAGO, April 25, 2013 — Lawyers, whether new to handling appeals before the U.S. Court of Appeals for Veterans Claims or seasoned practitioners, will find an invaluable tool in the book Veterans Appeals Guidebook: Representing Veterans in the U.S. Court of Appeals for Veterans Claims.

Five attorneys from the law firm of Finnegan, Henderson, Farabow, Garrett & Dunner LLP joined the American Bar Association to publish this book, which is extremely timely and relevant given the influx of veterans returning home from war and the constant flood of stories in the news about veterans issues.

Christopher Clay, general counsel of the Disabled American Veterans, observed: “I have read much of the literature on this subject, including the guidance published by some other institutions. The Finnegan book beats them all. … It is a gem. In addition to being readable and useful, the book’s simplicity is evidence of the fact that the contributors have achieved mastery of the subject matter.”

Veterans Appeals Guidebook assists lawyers representing veterans and other claimants who are pursuing appeals before the U.S. Court of Appeals for Veterans Claims. The book addresses the basics of appeals to the CAVC, explores the jurisdiction of the court and outlines the CAVC appellate process. The book will help facilitate appeals to the court and might even increase the chances for appellate success.

About the Authors

Ronald Smith, editor of the guidebook, is counsel for Finnegan’s Veterans’ Pro Bono Program and a counsel in its Intellectual Property Specialties Practice Group. Smith has prosecuted more than 400 veterans’ appeals in the federal courts, including before the CAVC and the Federal Circuit. The co-authors are Anita Bhushan, Elizabeth D. Ferrill, Stephen L. Hennessy and Maureen D. Queler, all active in Finnegan’s Veterans’ Pro Bono Program, which serves disabled U.S. military veterans, their dependents and their survivors.

CHICAGO, April 22, 2013 ‑ A new edition of Scientific Evidence Review: Admissibility and the Use of Expert Evidence in the Courtroom, Monograph No. 9 presents an updated overview of U.S. Supreme Court decisions regarding expert admissibility issues and focuses on state and federal court expert evidence issues.

The field of scientific interpretation of evidence and its portrayal in the media has created an environment in which expert testimony at trial is not only commonly accepted by judge and jury, but also expected. The book focuses on the Daubert-Joiner-Kumho Tire trilogy and other high court decisions that have established a standard for admissibility of scientific testimony in U.S. courts of law and helped foster that situation.

Scientific Evidence Review: Admissibility and the Use of Expert Evidence in the Courtroom, Monograph No. 9 is a valuable resource for lawyers and other interested readers that provides quick access to the governing expert evidence rules in federal and state courts across the United States. The circuit-by-circuit chapters are written by experienced attorneys with knowledge of the application of the rules regarding expert evidence in their specific jurisdictions. Included is guidance on factors to consider when selecting an expert and an examination of the impact on court decisions of the National Research Council’s 2009 report about the scientific foundation underlying forensic testimony.

CHICAGO, April 12, 2013 — A new American Bar Association book Music & Copyright in America: Toward the Celestial Jukebox provides a narrative history of the U.S. music business through a copyright perspective while capturing the policy debates that have shaped the industry.

Congressional debates and proposed legislation are bringing the biggest names in technology, broadcasting and music to Capitol Hill to address “performance royalties,” in particular, the formulas for determining the music royalty rates paid by Internet radio and streaming services compared with satellite radio providers and traditional broadcasters. These hotly contested issues will ultimately determine the future of music — who is best positioned to take advantage of the shifting terrain of the U.S. and global music business.

Music & Copyright in America highlights the intimate relationship between new technologies and the evolution of music copyright, revealing the degree to which historical debates inform current issues. Sections covering the Internet revolution and the rise of digital and cloud music services are placed in context by exploring the impact of other technologies — including radio itself — that burst onto the scene 100 years ago.

The book, by Kevin Parks, a Chicago-based attorney, has been called “deeply researched” and “beautifully written,” and has been praised as a “must-read” book that “succeeds marvelously” and is “a great contribution to the field.”
