Rule Making’s New Mass Appeal

The Obama administration aims to turn the regulatory process upside down, according to a White House official. Instead of putting out draft rules for public comment and then revising them into a final version, the Obama team aims to use blogs and other social media to generate public input even before rules are drafted. Officials say getting more constructive input from a wider community earlier in the process could help develop better regulations. ‘It inverts the traditional rule-making process,’ said Beth Noveck, the White House’s deputy chief technology officer, at an American Bar Association conference last week. ‘Instead of starting with a finished draft of a rule, we’re co-creating from the get-go and asking people what should be in such a rule before we write it,’ she said.
