Statement of ABA President Lamm Re: FTC Appeal of Loss in Red Flags Litigation

WASHINGTON, D.C., Feb. 26, 2010 — We are disappointed that the Federal Trade Commission has decided to appeal its loss of the Red Flags litigation in the District Court.  The D.C. Circuit Court of Appeals resoundingly upheld the American Bar Association’s lower-court victory in 2005 against the commission in the Gramm-Leach-Bliley lawsuit, and we are anticipating no less a victory in this case.

With nearly 400,000 members, the American Bar Association is the largest voluntary professional membership organization in the world.  As the national voice of the legal profession, the ABA works to improve the administration of justice, promotes programs that assist lawyers and judges in their work, accredits law schools, provides continuing legal education, and works to build public understanding around the world of the importance of the rule of law.
